In its capacity as data controller, EOMA (“EOMA” or the “Company”) takes the highest possible level of security measures in order to ensure that your personal data is processed lawfully and to protect your privacy.
The purpose of this notice is to inform you — as a person who visits and registers on the website https://eoma.ai/tr (the “Website”) belonging to the EOMA brand, and as a registered member (the “Data Subject”) — about the personal data processed, and, pursuant to Article 10 of Law No. 6698 on the Protection of Personal Data (the “Law”), about the methods of collection of your personal data, the purposes of processing, the groups of recipients to whom it is transferred, the legal grounds on which processing is based, and your rights.
1. Personal Data Processed
- Identity: your full name and title information.
- Contact: your address, e-mail address and telephone information.
- Transaction Security: your password and your login/logout records for the membership page.
- Advertising and Marketing Information: the advertising and marketing-related information we obtain from you within the scope of cookie usage.
- Online Service Data: your IP address, your log records and your location information.
2. Purposes of Processing Personal Data
The personal data obtained by EOMA through the Website will be used for the purpose of providing you with an effective, secure and high-quality service. Personal data is processed directly from the Data Subject themselves, in accordance with the personal data processing conditions set out in the Law, in proportion to the purposes specified below:
Establishment and Performance of the Commercial Relationship: carrying out information security processes; conducting activities in compliance with legislation; carrying out communication activities; carrying out activities to ensure business continuity; receiving and evaluating suggestions for the improvement of business processes; carrying out goods/service sales processes; carrying out after-sales support services for goods/services; carrying out goods/service production and operation processes; carrying out customer relationship management processes; carrying out customer satisfaction activities; carrying out contract processes.
Carrying Out Marketing, Advertising and Promotion Processes: carrying out communication activities; carrying out marketing analysis studies; carrying out advertising/campaign/promotion processes; carrying out the marketing processes of products/services; sending commercial electronic messages.
3. Method of Collection and Legal Grounds for Processing Personal Data
EOMA processes the personal data shared by the Data Subject through the Membership Form, in proportion to the purposes specified above, by automated and non-automated methods, in accordance with the legal grounds set out in Article 5 of the KVKK and explained below:
- EOMA entering into a contractual relationship with the Data Subject, or it being directly related to the performance of a contract that it has entered into with the Data Subject;
- processing of data being mandatory for the establishment, exercise or protection of a right; and,
- processing of data being mandatory for the legitimate interests of EOMA, provided that it does not harm the fundamental rights and freedoms of the data subject
and may be processed without explicit consent on the basis of these legal grounds.
4. Transfer of Personal Data and Its Purpose
Within the scope of the personal data processing conditions set out in Articles 8 and 9 of the KVKK and the purposes specified above, your personal data may be transferred to EOMA's service providers; and, for the resolution of legal disputes or as required by the relevant legislation, upon request, to authorized public institutions or relevant law enforcement authorities.
In the transfer of personal data, EOMA, within the scope of the data security measures taken, concludes special contracts with the parties to whom the transfer is made regarding the transfer and processing of data and obtains the necessary undertakings. Based on the explicit consent of the Data Subject, data may be transferred to our suppliers providing database and server services that require technical expertise and are resident abroad.
5. Data Security Measures
EOMA takes all kinds of administrative and technical measures possible within the cost balance of current technologies and the relevant application for the protection and security of your Personal Data, and in this context keeps its security-related practices up to date in line with the relevant legal regulations and the decisions of the Personal Data Protection Board.
6. Rights of the Data Subject
If you submit your requests regarding your rights to EOMA by the methods set out below, EOMA will conclude the request as soon as possible and within thirty days at the latest, depending on the nature of the request. No fee will be charged for responses of up to ten pages. A processing fee of 1 Turkish Lira will be charged for each page exceeding ten pages. If the response to the application is provided on a recording medium such as a CD or flash memory, the fee that may be charged by EOMA will not exceed the cost of the recording medium.
As the Data Subject, pursuant to Article 11 of the KVKK, you have the following rights:
- to learn whether your personal data is being processed,
- to request information if your personal data has been processed,
- to learn the purpose of processing your personal data and whether it is used in accordance with its purpose,
- to know the third parties to whom your personal data is transferred domestically or abroad,
- to request the correction of your personal data if it has been processed incompletely or incorrectly, and to request that the transaction carried out in this regard be notified to the third parties to whom the personal data has been transferred,
- to request the deletion or destruction of your personal data in the event that the reasons requiring its processing cease to exist, even though it has been processed in accordance with the provisions of Law No. 6698 and other relevant laws, and to request that the transaction carried out in this regard be notified to the third parties to whom the personal data has been transferred,
- to object to the emergence of a result against the person themselves by means of the analysis of the processed data exclusively through automated systems,
- to request the compensation of the damage in the event that you suffer damage due to the unlawful processing of personal data.
You may submit your request regarding the exercise of the rights specified above, in Turkish; in writing, to EOMA, in its capacity as data controller, at the address “Ortabayır Mah. Talatpaşa Cad. No:21 İç Kapı No:501 Kağıthane / İstanbul”, together with documents verifying your identity, via registered electronic mail (KEP) address, secure electronic signature, mobile signature, or the electronic mail address that you have previously notified to EOMA and which is registered in EOMA's systems; by electronic mail to legal@eoma.ai or by other methods determined by the Personal Data Protection Authority.
EOMA reserves the right to verify your identity before responding.
Your application must contain;
- your name, surname and, if the application is in writing, your signature,
- for citizens of the Republic of Türkiye, your T.R. Identity Number; if you are a foreigner, your nationality, your passport number, or your identity number if any,
- your place of residence or business address for notification purposes,
- your electronic mail address, telephone and fax number for notification purposes (if any),
- the subject of your request,
and it is also required that the relevant information and documents on the subject, if any, be attached to the application.
Data subjects who give their consent for the purpose of sending commercial electronic messages to EOMA may, at any time and without stating any reason, refuse to be contacted — via the contact details they have provided — regarding general and special campaigns, advantages, product and service promotions, advertising, market research surveys and other customer satisfaction practices. Data Subjects may submit such refusal notification through the other relevant channels mentioned above.
In accordance with the Data Subject's explicit notification on this matter, communications to that party through the channels specified are stopped within the maximum legal period (transactions and communications that are possible/required under the law continue).
